Client's Customers/Leads: Individuals whose Personal Information we may process on behalf of our Clients in the course of providing Services (e.g., leads generated, managed, or contacted through our AI systems). Our processing of such data is primarily governed by our agreements with our Clients.
Influencers & Workers: Individuals who have a contractual or employment relationship with Convert AI (specific terms may be provided separately for employment).
Our Services are primarily designed for home service businesses and we specialize in AI-powered lead conversion, automated communications, and appointment setting systems for these industries.
"Personal Information" means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household.
We may collect the following categories of Personal Information:
Direct Identifiers: Full name, postal address, email address, phone number, account usernames, IP address, online identifiers.
From Clients/Influencers/Workers: Federal Taxpayer Registry (RFC), Official Identification (IFE/INE), Unique Population Registry Code (CURP) (if applicable based on your operational needs and legal requirements for these individuals, primarily if they are in jurisdictions requiring this), Social Security Number (for workers, where legally required for employment).
Name, signature (where applicable for contracts), address, telephone number.
Financial Information: Bank account details, payment card information (processed securely through third-party payment processors like Stripe or PayPal), transaction history.
Age/date of birth (e.g., for age verification if necessary for a service). Marital status (e.g., for workers/influencers for administrative purposes).
Records of services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies. Information about your business (for Clients). Social media account details and performance metrics (for Influencers or as part of Services for Clients). Lead data, prospect information, and customer databases provided by Clients.
Browsing history on our website, search queries, interaction with our website, emails, advertisements, or AI systems (e.g., chatbot interactions). Operating system, browser type, device information. Usage data related to our Services.
General location derived from IP address. Precise geolocation only with your explicit consent if a specific service requires it.
Photographs or videos you provide or that are captured as part of the Services (e.g., for creator content, testimonials) with your consent. Recordings of calls with our customer support (with prior notification and consent where required).
Audio recordings of AI voice agent calls (where legally permitted and with appropriate notice). Transcripts and conversation logs from AI interactions with leads and prospects. Response data and engagement metrics from automated communications. Appointment booking confirmations and calendar integration data. SMS message content and delivery records from automated text messaging campaigns. Email campaign data and engagement metrics from automated email sequences.
Phone call records and conversation logs from our AI voice agents. Call consent records and opt-out preferences for TCPA compliance. Do-not-call list compliance data and telecommunications preferences. Call timing, duration, and outcome data for performance optimization.
For Workers and Influencers: Employment history, qualifications, resume information.
Profiles reflecting a person's preferences, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes, particularly in the context of providing personalized Services or through AI analysis (e.g., to enhance lead conversion strategies or to optimize automated communication timing and messaging).
Health-Related Information (if you are a Client or User directly providing this for a specific service, e.g., a personalized wellness plan): Information about dietary preferences, allergies, physical activity preferences, or other health conditions only when you voluntarily provide it for a specific service and provide explicit consent for its use for that purpose. We do not routinely collect this.
Financial Account Log-In Information (e.g., Stripe or PayPal user account info provided by you for service integration): We typically direct you to these providers for account linking and do not store your full login credentials.

If we are processing your Personal Information as a service provider to one of our Clients (e.g., you are a lead or customer of our Client), we will share your information with that Client as directed by our agreement with them. Our Clients are responsible for their own privacy practices regarding the data we process for them.
When processing lead data on behalf of our Clients, we act as a "data processor" (under GDPR) or "service provider" (under CCPA). In these cases:
Our Clients are the data controllers who determine the purposes and means of processing
We process lead data solely according to Client instructions and our service agreements
Leads should refer to our Client's privacy policy for information about how their data is handled
We do not use Client lead data for our own marketing or business purposes beyond providing contracted services

If you choose to connect your social media accounts or share content from our Services on social media, your information will be shared with those platforms, governed by their privacy policies.

If Convert AI is involved in a merger, acquisition, financing due diligence, reorganization, bankruptcy, receivership, sale of all or a portion of its assets, or transition of service to another provider, your Personal Information may be sold or transferred as part of such a transaction, as permitted by law and/or contract.
Any and all prospective customer leads, contact information, or inquiries ("Leads") generated, identified, or processed by Convert AI specifically for a Client as a direct result of the Services performed under an agreement with that Client are the exclusive property of that Client.
Call Recording and Communication Data: Any call recordings, conversation transcripts, SMS message logs, email campaign data, or other communication data generated through our AI systems while servicing a Client are considered part of the Client-exclusive data and are subject to the same exclusivity provisions.
Convert AI will not, during or after the term of the agreement with the Client, directly or indirectly: (a) use such Client-exclusive Leads for its own commercial purposes or for the benefit of any third party other than the Client; (b) sell, trade, distribute, or otherwise disclose such Client-exclusive Leads to any third party without the Client's express prior written consent, except as necessary to provide Services to that Client or as required by law.
Telecommunications Compliance: We comply with the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, and other applicable telecommunications regulations. We only make automated calls or send automated text messages to leads who have provided appropriate consent or where we have a pre-existing business relationship as permitted by law.
Call Recording Notice: Our AI voice agents may record calls for quality assurance, training, and compliance purposes. Where required by law, we will provide notice before recording begins. Recorded calls are securely stored and only accessed by authorized personnel for legitimate business purposes.
Opt-Out Rights: Individuals receiving automated communications from our AI systems have the right to opt-out at any time by:
Saying "stop," "opt-out," or requesting removal during an AI voice call
Replying "STOP" to automated text messages
Clicking unsubscribe links in automated emails
Contacting us directly to be added to our do-not-contact list
Do-Not-Call Compliance: We maintain internal do-not-call lists and honor all opt-out requests. We also comply with the National Do Not Call Registry and other applicable telecommunications regulations.

However, no internet or email transmission is ever fully secure or error-free. While we strive to use commercially acceptable means to protect your Personal Information, we cannot guarantee its absolute security.
Our Services are not directed to children under the age of 13 (or a higher age threshold if applicable in your jurisdiction, e.g., 16 in some cases under GDPR or for certain CCPA rights). We do not knowingly collect Personal Information from children under these ages.
